FAQ regarding the contents of the will

All legal services are provided exclusively by Merritt Legal Consultants FZ LLC.

This is entirely possible, but consulting a professional is always recommended to ensure that its form and content fully comply with local regulations, and especially with the law applicable to your succession, in order to avoid disputes among the heirs.

Furthermore, to register a will with the DIFC, you must engage a lawyer authorized by the DIFC (“Wills Draftsmen”).

The will may be drafted in English, Arabic, or both English and Arabic. French is not accepted, but a certified French translation can be provided upon request.

All assets located in the United Arab Emirates can be included in your will registered with the DIFC: real estate, bank account, car, boat, painting, etc.

Animals and plants cannot be included.

Yes, it is now possible to include assets located in Emirates other than Dubai and Ras Al Khaimah in the DIFC will.

Several cases are possible:

  • For real estate assets: it is usually the law of the country where these assets are located that applies in inheritance matters (to be verified on a country-by-country basis).
  • For non-real-estate assets: if you are a resident of the Emirates, the Emirates will applies unless local regulations provide otherwise. If you are not or are no longer a resident of the Emirates, the law of your country of residence will apply.
